Many agencies are unaware of California Streets & Highways (S&H) Code Section 5610, a statute that allows members with sidewalks to transfer the risk and expense of sidewalk repairs and maintenance to adjacent private property owners. However, the statute doesn’t absolve agencies of all responsibility for inspecting and maintaining sidewalks.
